Can Microsoft ban users from Xbox Live for playing backed up or burned games on a flashed or modded

i was recently thinking about flashing my xbox to play burned games, and almost jumped into doing it, but heard you can be banned from xbox live....

1. is this true, can you really get banned?

2. can microsoft know if you have a flashed xbox 360 and if you are playing burned games? how?

3. is there any way to avoid it?

please only respond to my questions if you have a near certain answer....thanks!

OK, this has happened to me and a number of my friend's, so I am speaking from personal experience. Yes, Microsoft will definitely ban your 360. It may not happen for a while, but they will get it eventually. It could be a week, a day, a year, but they will get it. To play back burned games, you need to flash the DVD drive in the 360. This used to work fine, but MSFT built in a detection system on the motherboard that can tell if the DVD has been flashed. Here is the deal, MSFT WILL ONLY BAN YOUR 360 CONSOLE ITSELF, NOT YOUR LIVE ACCOUNT OR ACHIEVEMENTS. In other words, you could pull your hard drive off the 360 that is banned and put it on any other 360 and it will be exactly where you were. Do not listen to these other people, as they definitely do not know what they are talking about. I live in NYC and I have dozens of friend's that got there CONSOLES baned and NO ONE had there LIVE account banned or affected in any way. It's basic economics. MSFT wants you to go out and buy another 360, so why would they ban your LIVE account? They want to keep you hooked.
